Privacy Policy

UP Creative Marketing Assistant Service ("MA Service" or "we") Privacy Policy is designed to help you understand how we collect and use information on the Independent contractor employment agreement of the MA Service (the "System"). MA Service is a product of UP Creative, Inc. By entering into a 1099 independent contractor agreement with UP Creative, Inc. under your employee by registering on or visiting the System, you are acknowledging and accepting this Privacy Policy. We may from time-to-time revise this Privacy Policy, and the date of last revision will be available at the top of this page, so please be sure to check back periodically. Your continued use of the Site after changes have been posted to the Privacy Policy will constitute your acceptance of such changes.

The Information We Collect as an Independent contractor under your employee

Personally identifiable information is information that others can use to identify you, such as your name, address, email address, credit card number or phone number. When you register on and throughout your use of the Site you provide Up Creative, Inc. with certain personally identifiable information including without limitation to your name, address, ZIP Code, email address, telephone number, information about whether you plan on buying and/or selling property, home search criteria, information about financing for the purchase of property and other information related to the sale and/or purchase of property.

Additionally, MA Service servers automatically record information sent by your browser when you use the system, including Internet Protocol address, browser type and language, and date and time of request. We may also collect information using cookies, web beacons or similar technologies.

When you send email or other communication through the MA Service, we may retain those communications in order to process your inquiries, respond to your requests and improve our service.

How We Use Information

Depending on your use of the Site and the services you request through the MA Service under an independent contractor agreement under your employee, we may use your personally identifiable information for the following purposes:

  • To enable our MA Service Sales Agents to contact you and provide personal service, or to provide you with personalized content, including email messages and/or search results.
  • To facilitate all aspects of the sale and/or purchase (or potential sale and/or purchase) of real estate.
  • For the purposes for which you provided the information, including to process and respond to inquiries and to contact you about services you have requested.
  • To improve the content and navigability of the System.
  • To solicit your feedback about our services.
  • To alert you to new System features, promotions, services, and to deliver other information from which you may opt out.
  • To enforce the Terms of Use.

In the future, we may sell some or all or our assets. In such transactions, customer information generally is one of the transferred business assets. In the event of a sale of our assets including our database, customer information will be transferred. We will require buyers to honor our privacy policy.

Sharing Of Information

UP Creative, Inc. may disclose your personally identifiable information to another entity (i) for purposes of outsourcing one or more of the functions described in the previous section; (ii) to confirm or update information provided by you; (iii) to inform you of important information; (iv) as a part of a sale of assets as described in the previous section; (v) with other companies for the purposes of marketing products to you after obtaining your consent; and/or (vi) as otherwise authorized by you.

UP Creative, Inc. will provide you with an opportunity to opt-in to share information with and receive information from UP Creative, Inc. partners. When you opt-in to share information with and receive information from UP Creative, Inc. partners, your information will be shared with these partners at UP Creative, Inc.'s discretion. You may at any point withdraw your consent to share information with these third parties by sending an email with the subject "Do Not Share Information" to Up Creative, Inc. will stop sharing your information within 10 (ten) days after receiving your request; provided, however, that information shared prior to that time will remain in the possession of UP Creative, Inc.‘s partners and may continue to be used consistent with this Privacy Policy.

UP Creative, Inc. may transmit your personally identifiable information to third parties involved with your sale and/or purchase (or potential sale and/or purchase) of real estate. These parties include, but are not limited to insurance providers, lenders, appraisers, home warranty providers and inspectors. You also give UP Creative, Inc. permission to transmit your personally identifiable information to other parties or real estate agents involved in your sale and/or purchase process.

You may choose to work with companies that are not affiliated with or related to UP Creative, Inc., including without limitation to lending institutions, title companies, insurers, appraisers, home warranty companies and other service providers, in connection with your real estate transaction. These companies may each have their own privacy policies governing how they handle your personally identifiable information. UP Creative, Inc. accepts no responsibility or liability for third party privacy policies or the actions of any third party with respect to your personally identifiable information.

We may also share your information in response to a subpoena, legal order or official request, when we believe you have acted in violation of the Terms of Use, or when we believe that doing so may protect your safety or the safety of others.

Information that is de-identified (stripped of any information that could be used to identify you) may be used by UP Creative, Inc. for any reason and shared freely with affiliates, the press, partners and other third parties. This information is usually aggregated (combined with information from many other users), and may include information such as Site traffic patterns, trends, demographics, search patterns and other information.

Third Party Advertising

Third-party advertisers may serve you ads when you visit the Site. Some of these companies may use information about your usage of MA Service and other Systems in order to provide advertisements about goods and services that may be of interest to you.

How We Use Cookies

A "cookie" is a small data file that can be placed on your hard drive when you visit certain websites. When you visit the System, MA Service sends one or more cookies to your computer that uniquely identifies your Internet browser. We use cookies to collect, store and sometimes track information for statistical purposes to improve the services we provide. If you are a registered and paid user, we will use a cookie to save your settings and to provide customizable and personalized services. Advertisers and partners may also use their own cookies over which Up Creative, Inc. has no control.

How We Protect Information

UP Creative, Inc. attempts to protect against the loss, misuse and alteration of your personally identifiable information. Our servers are protected by reasonable physical and electronic security measures.


The MA Service may contain links to third-party websites. UP Creative, Inc. is not responsible for the privacy practices or the content of such websites.

California Privacy Rights

If you are a California resident, you are entitled by law to request an Information Sharing Disclosure. If you request it, we will provide you with a notice of your right to prevent sharing of your personally identifiable information as well as a cost-free means of doing so. To receive such a notice, submit a written request to the address listed in the Contact section below, specifying that you seek your "California Customer Choice Notice." Please allow thirty days for a response.

Account Deactivation

Support for the system is constructed and offered via using the system and creating support tickets. MA Service support staff will answer all email, phone, and chat support tickets within 48-hours of receipt. Cancellation must be made by creating a support ticket to do so. You will not be able to access the System or any of the services offered by MA Service after your cancellation is processed and the end of your remaining contract term has passed.

Viewing and Updating Your Information
